New York Residents: Keep Your Supplements Free of Deceptive Labeling

New York state senator Kenneth LaValle once again has introduced legislation attacking nutritional supplements. This time he wants to subject supplements to misleading labeling requirements.

Sen. LaValle’s bill would make it mandatory for dietary supplements sold in New York to state whether or not the product has been tested by the FDA. But the FDA doesn’t test any products whatsoever (not even drugs), and supplements are already rigorously regulated by the FDA and FTC!

This proposed labeling requirement will be tremendously confusing to consumers and will have zero informative value. It will also place an unnecessary burden on supplement makers.

I am writing to voice my strong opposition to your bill, S00015. It would require products that are labeled as dietary supplements or nutritional supplements to carry a label stating whether the product has or has not been tested by the US Food and Drug Administration (FDA).

But surely you know that the FDA doesn't test ANY products whatsoever -- not even drugs -- and supplements are already rigorously regulated by multiple federal agencies! Your label would tremendously confuse New York consumers about the regulation and safety of supplements. This will ultimately harm consumers -- your constituents -- instead of making them safer.

Dietary supplements are fully regulated by both the FDA and the FTC, ensuring that the products are safe and that product labels are truthful and accurate. Moreover, in the Dietary Supplement Health and Education Act of 1994 (DSHEA), Congress explicitly decided to regulate supplements as a category of food. As such, dietary supplements are not subject to the same approval process as drugs or pharmaceuticals. The text of your legislation contradicts well-established federal regulations.

To require a label to state whether a product has been tested by the FDA (when the FDA doesn't do any testing at all) deliberately misleads the public about the regulatory system. It also appears to cast doubt on the safety of nutritional supplements, when they have been proven safe again and again.

Furthermore, this bill would result in a double standard for dietary supplement manufacturers who sell products in New York by requiring a special label for New York only. This will dramatically drive up the cost of vitamins and minerals for the millions of New York consumers who depend on nutritional supplements -- while providing no added protection whatsoever. Many manufactures may even stop manufacturing and selling products in New York.

In short, SB200015 would create misleading and burdensome requirements that will do nothing except confuse New York consumers and drive up prices. For these reasons, please WITHDRAW this bill, and do not introduce similar legislation in the future.
