As you know, the FDA has been issuing rules to implement the Drug Quality and Security Act for compounding pharmacies. This act gave the FDA increased authority over compounding pharmacies, and the agency has responded by trying to regulate compounding pharmacies, and the customized medicines they produce for patients, out of existence.

Among other limits, new FDA rules would eliminate "office use" of compounded drugs, where a physician, in his or her office or other treatment area, administers a compounded medicinal preparation directly to a patient for the immediate treatment of a problem. Most state boards have allowed physicians to keep a supply of compounded drugs on hand without prescriptions.

This new regulation is in direct violation of congressional intent. In fact, some legislators wrote a letter to the FDA reiterating that it was Congress's intent to leave office use up to the states! In a written response, the FDA stated that "a compounding pharmacist may not dispense compounded medications for office use, but rather, must obtain a prescription for an individually identified patient."

This is just one component of FDA's attack on the customized medicines produced by compounding pharmacies. Unless congressional intent is upheld, patients may lose access to important and life-saving medications like bioidentical estriol, time-release natural thyroid, special supplements, and nutrient IV vitamin treatments.

In many cases, compounding is the only way for consumers with special needs to access a number of important natural medicines, as well more natural ways to take those medicines.

Due to the urgency of this issue, I'm asking you to support the inclusion of language in the FY 2017 appropriations bill that withholds funding for the enforcement of 503A(a) of the Food, Drug, & Cosmetic Act pertaining to the requirement that a drug be compounded for an identified individual patient based on the unsolicited receipt of a valid prescription, until FDA issues a final guidance explaining how pharmacies can continue to engage in non-patient specific 'office-use' compounding.
